Legal
Terms
01 About these terms #
These terms apply when you use pepperhorn.com or buy from it. The site is run by PepperHorn Music ([[OPERATOR: legal entity name (e.g. the company or sole trader behind PepperHorn Music)]], ABN 34 527 834 782), based in Woodend, Victoria, Australia. "We" and "us" means PepperHorn. "You" means the person using the site, or the organisation they buy for.
By creating an account or placing an order you agree to these terms. Our Privacy policy explains how we handle your personal information. These terms are written in English, and the English version is the one that applies.
02 What you are buying #
When you buy from PepperHorn you are buying a licence to use a piece of sheet music or related media. You are not buying the copyright in the music or the arrangement. The copyright stays with its owners, and we or the people we license from keep all rights not given to you.
Each licence is issued to the person or organisation named on it. The product page and the licence itself say what it covers: [[OPERATOR: what each licence permits (number of copies, rehearsal and performance use, recording, organisation vs personal use)]].
Every licensed PDF is stamped with the licensee's name, a licence number and a verification link, so a copy can always be traced to its licence.
03 Using your licence #
Unless your licence says otherwise, you must not:
- share, sell, lend, upload or otherwise distribute the files, or copies of them, to anyone not covered by your licence;
- remove, hide or alter the stamp, licence number or copyright notices;
- use the music beyond what your licence allows.
A licence can be suspended or revoked if it is refunded or misused. A suspended, revoked or expired licence can no longer be downloaded. If a licence has an end date, it is valid up to and including that date.
04 Prices and currency #
Our prices are set in US dollars. Australian customers see and pay prices in Australian dollars. These are set by us, not converted at an exchange rate, and include GST. Everyone else pays in US dollars.
The price you pay is the one shown at checkout. If we get a price obviously wrong, we may cancel the order and refund you in full.
05 Payment #
Orders in Australian dollars are paid through Square. Orders in US dollars are paid through Stripe. You enter your card details with them, not with us. Your licence is issued once the payment is confirmed.
06 Delivery and downloads #
You download licensed files from your library. Each download uses a private link that expires after a short time (10 minutes by default); you can get a new one from your library whenever your licence is active. Audio and video files come as a .zip.
07 Returns and refunds #
Because a downloaded file cannot be given back, you can return a licence for a refund only if both of these are true:
- you have not downloaded the licence's files yet (this counts as soon as we give you a download link); and
- it is within 48 hours of your order being completed.
When a licence is refunded it is revoked and can no longer be downloaded. Outside these rules we may still agree to a refund case by case. Nothing in this section limits your rights under the Australian Consumer Law, set out next.
08 Australian Consumer Law #
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
For example, if a file you bought is faulty, incomplete or not as described, contact us and we will fix it, replace it or refund you, whether or not you have downloaded it.
09 Your account #
You need an account to buy. You sign in with a one-time code sent to your email, so keep your email account secure; anyone who can read your email can sign in as you. Give us accurate details, including your country, because it decides your currency and tax.
Age: You must be 16 or older to create an account or buy from PepperHorn Music. We chose 16 because it is the highest age of digital consent that any EU/EEA country sets under GDPR Article 8, which covers consent-based processing of personal data for online services offered directly to children. That rule does not decide whether someone below the age of majority can enter a contract; national law governs that. We do not open accounts or sell to anyone under 16, and we have no parental-consent route. If you are buying for a younger student, you (or their teacher or school) buy and hold the licence yourself.
We may suspend or close an account that breaks these terms, is used for fraud, or puts the site or other users at risk. Where it is reasonable, we will tell you why first. Licences you have already paid for and used properly are not affected by closing an account unless they were misused.
10 Acceptable use #
When using the site you must not:
- break the law or anyone's rights, including copyright;
- try to get around download limits, licence checks, sign-in limits or other security;
- scrape, copy or republish the catalogue, scores or previews in bulk;
- interfere with the site or other people's use of it.
11 Our liability #
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Apart from those rights, and to the extent the law allows: we are not liable for indirect or consequential loss, and where we are allowed to limit our liability for a failure to meet a consumer guarantee, our liability is limited to supplying the goods or services again, or paying the cost of having them supplied again.
12 Governing law #
These terms are governed by the laws of [[OPERATOR: governing law: Australian state or territory]], Australia, and you and we submit to the courts of that place. This does not take away any protection you have under the consumer laws of the country where you live.
13 Changes to these terms #
We may update these terms. The date and version at the top of this page show which version applies. Changes do not affect orders you placed before the change. If a change matters, we will tell you by email or on the site before it takes effect.
14 Contact us #
Email [[OPERATOR: general contact email for terms questions]], or use our support form. Post: [[OPERATOR: postal or registered address for legal notices]].
